First, this is absolutely the best location to stay in Park City. Ski-in, Ski-out. Lockers for your equipment. The staff was outstandingly nice too. Just fantastic from that standpoint...

Cancellation

  1. StayPC Inc. Property Management and the undersigned (Guest) are the parties to this agreement (the Agreement) to rent the Property listed above in Park City, Utah (Condo) managed by StayPC Inc. and agree to be bound by the following terms:

  2. Guest acknowledges, understands, and agrees to be a licensee of StayPC and not a tenant; and as such acknowledges that Guest is not acquiring any property interest in the Condo.

  3. Guest agrees to occupy and use the Condo in a manner as to not disturb neighbors. StayPC Inc. may terminate this Agreement and ask disruptive Guests to leave the Condo.

  4. Information regarding the Condo, furnishing, and amenities is believed to be accurate, but cannot be guaranteed.

  5. When Guest agrees to rent Condo and pays a deposit, StayPC Inc. will take Condo off the market for the agreed upon dates and hold it exclusively for Guest. Therefore, cancellations are subject to NO REFUND. Outstanding balances are due prior to arrival and non-payment will result in loss of deposit. There is no refund for travel or weather related occurrences. Notwithstanding the foregoing, StayPC Inc. will attempt to rent the Condo to another guest upon notice of cancellation and will refund any rent actually received from another guest for the same term, less a cancellation fee of $100.00 (one hundred dollars).

  6. The Security Deposit will be used to replace and or repair any items that are missing or damaged by Guest during the stay. The cost to replace any damaged or missing items or to repair any damages to the Condo will be charged to Guest`s credit card. Guest will be provided a receipt with the breakdown of the charges.

  7. Guest acknowledges and agrees that checkout time is no later than 10:00 AM and check-in time is no earlier than 4:00 PM.

  8. GUEST SHALL BE SOLELY RESPONSIBLE FOR ANY DAMAGE, ACCIDENT, INJURY TO ANY PERSON OR LESS SUSTAINED BY ANY PERSON, INCLUDING LOSS OF MONEY, JEWELRY, AND OTHER ITEMS OF PERSONAL PROPERTY, ARISING FROM OR IN ANY WAY CONNECTED TO GUESTSUSE OF THE PREMISES OF THE ITEMS OF PERSONAL PROPERTY PROVIDED BY STAYPC INC. AT THE GUESTS REQUEST. GUEST SHALL INSPECT AND BE FAMILIAR WITH THE PROPER USE AND APPLICATION OF SUCH ITEMS PRIOR TO USING THEM. GUEST HEREBY AGREES TO INDEMNIFY AND HOLD HARMLESS THE PROPERTY OWNER AND STAYPC INC. FROM ANY AND ALL CLAIMS INCLUDING THOSE OF A THIRD PARTY, ARISING OUT OF OR IN ANY WAY CONNECTED TO GUESTS USE OF THE PREMISES OR OTHER ITEMS OF PERSONAL PROPERTY PROVIDED THEREIN. GUEST ASSUMES THE RISK OF INJURY OR OTHER LOSSES RELATING TO ANY RECREATIONAL ACTIVITIES AND WILL HOLD OWNER AND STAYPC INC. HARMLESS WITH RESPECT THERETO.

  9. Guest agrees to leave Condo in a clean, undamaged, condition and with all inventory present on arrival. If unit is not left in suitable condition, or items are missing from the Condo, Guest understands that StayPC Inc. reserves the right to charge Guest for any repairs, special cleaning, or missing items. In addition to Guests Security Deposit, Guest authorizes StayPC Inc. to charge Guests credit card in the amount of any damages or missing inventory exceeding the Security Deposit collected.

  10. There is no phone service provided at the Condo.

  11. Guest agrees that the Condo shall not be occupied by more than the number of people stated on the Condo`s website.

  12. The Condo is a NON-SMOKING unit and accordingly smoking is not permitted in unit or on premises. Pets are NOT ALLOWED in Condo or on the premises. A special cleaning fee, a minimum of $250.00 (two hundred and fifty dollars) will be assessed for EACH violation of this paragraph.

  13. Guest agrees that StayPC Inc. or its Agent may enter Condo for necessary repairs and/or maintenance. Infrequently failures occur such as appliances, cable service, power outages, common area hot tub, pool and other amenities. While StayPC Inc. has a very capable staff and will make every effort to have repairs performed quickly and efficiently, no guarantees are made and Guest will not be entitled to monetary compensation or refund for amenities deemed unusable.

  14. If the Condo or the Condo complex has a private or a common area hot tub and/or pool on the premises, StayPC Inc. will provide access to these amenities, but makes no guarantees as to the exclusive use or working condition of the common area amenities provided by the home owner`s association.

  15. Guest agrees to use common area facilities including but not limited to; hot tub, pool and work out facility at their own risk. Children should not use the hot tub without adult supervision. Guest agrees to observe and obey all posted signage in regards to common area facilities.

  16. Guest shall not sublet the Condo.

  17. Guest will be provided with a code to keyless entry located on the door of the unit prior to arrival.

  18. There is no maid service on the premises. StayPC Inc. can be contacted by phone or email at any time with any questions. Linens, dishes, kitchen appliances, and standard toiletries are provided in the premises for your convenience.

  19. Guest agrees to pay StayPC Inc. the rate of $1,000.00 (one-thousand dollars) per night for any holdover after term of license unless other arrangements have been made in writing.

  20. Guest and StayPC Inc. both agree that this License shall not be for more than (30) days and that the laws regulating hotels and motels in the state of Utah shall apply.

  21. Guest and StayPC Inc. agree that any unsettled dispute arising from this Agreement shall be under the jurisdiction of the State of Utah courts and in accordance with the laws of the State of Utah. Guest agrees to pay all costs of collection regardless of legal action. If legal action is required for collection, the prevailing party shall be entitled to attorney`s fees and court costs in addition to any monetary settlement.
